Terms And Conditions:
In these Conditions of Sale
(1) ‘The Goods’ means all items described in the Contract.
(2) ‘The Buyer’ means the person, firm or company with whom the Contract
is made for the sale of the Goods.
(3) ‘The Contract’ is a contract for the sale of goods.
(4) ‘The Seller’ is the company Alpinecrest Limited T/A Amazing Emporium or
subsidiaries thereof.
Trading Terms are regulated by The Sale of Goods Act 1979 (as amended)
together with The Sale and Supply of Goods and Services Acts 1982.
(1) When any Goods found not to be of:
(a) Satisfactory quality
(b) Fit for the purpose
(c) Not as described
the Buyer will be entitled to a full refund.
(2) However, subject to a reasonable time subsequent to purchase where
the Goods are deemed to have been accepted, only a part refund for
compensation will be given if the complaint is seen by the Seller to be
justified. (no money is refundable but a credit note will be raised and
valid for a reasonable period of time.)
QUOTATIONS
All prices are quoted on ex shop basis. All transport at Buyer’s
expense. Quotations are valid for one month only.
OWNERSHIP
Title of The Goods remains with the Seller until payment is received in
full.
LOSS OR DAMAGE IN TRANSIT
No claim for damage in transit, shortage of delivery or loss of Goods
will be entertained unless, in the case of damage in transit or shortage
of delivery, it is brought to the attention of the carrier or Seller
upon receipt of Goods, and in the case of loss of Goods, notice is given
to the carrier concerned and to the Seller and a complete claim in
writing made within a reasonable period of time from the date of
invoice. Where Goods are accepted from the carrier concerned without
being checked by the Buyer, the delivery book of the carrier concerned
must be signed and a reason why must be given.
CLAIMS
Claims for damage to Goods (if delivered by our own vehicle fleet) must
be submitted to the attention of the Seller within a reasonable period
from receipt of Goods. If Goods are delivered by carrier, written
notifications must be submitted within a reasonable period of time from
delivery to give reasonable time for inspection.
PRICES
Whilst we make every endeavor to adhere to quoted prices, any transport
charges are not included (to or from the Buyer).
VAT
All prices quoted by the Seller are inclusive of VAT unless otherwise stated. VAT is charged at the rate which is ruling at date of payment.
WARRANTY AFTER ACCEPTANCE
In the unlikely event of the Goods proving unsatisfactory due to the
nature of wooden materials, the Seller undertakes at our own expense to
repair or replace as far as is possible for a period of 12 months from
date of sale. We do not guarantee wear and tear or any personal damage.
Please note when furniture is made out of solid timber, cracks may occur
with variation of temperature and humidity. Natural materials sometimes
vary with natural environment. Reclaimed timber sometimes shows what may
appear to be defects but is actually the nature and the character of the
natural wood. Pine is soft wood with character. Dents are not natural
but can only add to its natural character. When and if any return of
Goods, Goods exchanged or repair is undertaken by our company the
Seller, any transport charges are at the Buyer’s cost.
Beds, Divans and Mattresses: For hygiene and health reasons, unless due
to a manufacturing fault in no circumstances can a bed, divan or
mattress be exchanged or have money refunded.
SPECIFICATIONS
The Company reserves the right to improve, alter or modify the design or
sizes without prior notification. If goods are supplied to the Buyer’s
own specifications, the Buyer shall be solely responsible for ensuring
that they are accurate.
DIMENSIONS
It is the Buyer’s responsibility to ensure that the Goods are the
correct dimensions both for access to his/her property and the space for
which the Goods are intended.
DRAWINGS - BROCHURES - DOCUMENTATION
All drawings, descriptions, illustrations, weight and dimensions given
in the Company’s catalogue, price lists or other advertising matter are
approximate and intended for general guidance purposes only.
PROPER LAW
The contract is and shall be deemed to have been made in England and
shall be in respects be covered by English Law and shall be subject to
the jurisdiction of the English courts.
CANCELLATION
When it is the customer(s) wish:
(1) The deposit (50% of the total purchase) is not refundable.
(2) An administration fee of £35 is chargeable.
This does not affect your statutory rights.
STORAGE
If for any reason the Buyer is unable to accept delivery of the Goods at
the time when the Goods are ready, The Seller shall be under no
obligation to store the same. The Seller may however, at its discretion
and if storage facilities permit, store the Goods but at the Buyer’s
risk and the Buyer’s shall be liable to The Seller for the reasonable
cost (including insurance) of it so doing. Please note that The Seller
is not responsible for purchased items left on the premises over 60
days, and reserves the right to dispose of Goods not collected and paid
for after this period. No refund will be considered. The Buyer will be notified in writing.
DEPOSIT
Unless otherwise stated a minimum deposit of 50% is usually required.
This is not refundable on cancellation by the Buyer.
REFUND
Any refund is subject to a £35 administration fee.
CREDIT
When credit is available it is subject to status. Please ask for a
written quotation.
VISIT TO CUSTOMERS
Any request of visits to The Buyer’s premises is accepted only on our
discretionary terms and will be subject to charges.
IMPORTANT
All Goods must be paid for in total before any collection or delivery
arrangements can take place. All balances must be settled prior to
delivery.
PAYMENT
Please note - total balances must be paid either prior to delivery, 10
days before to allow for cheques to clear, or cash only. No personal
cheques will be accepted without a relevant banker’s card. Before Goods can be released, payment must be made by either credit card or cash. Bankers draft and cheques will be accepted, subject to being cleared. Please allow 10 days.
Cheques and Banker’s Drafts are to be made payable to Alpinecrest Ltd
PRICES
All prices quoted exclude transportation unless otherwise stated. Any
transport charge is for one way only. Any return is at the buyer’s
expense. Prices are in Sterling and include VAT.
DELIVERY
Deliveries by the company are taken in good faith, on the strict
understanding that it is wholly the BUYER’S responsibility to verify and
ensure that the Goods
concerned can gain access freely to the desired area with no
difficulties whatsoever. Should these precautions be overlooked
resulting in Goods being returned to us, all delivery charges to and
from the premises will be charged to the buyer if cancellation follows
the return of the Goods.

DISTANCE SELLING REGULATIONS
This paragraph sets out those items required pursuant to the EC Directive on Distance Selling (Directive 97/7) as ratified by the Consumer Protection(Contacts Concluded by means of Distance Communications) Regulations 2000.

b. Description of Goods The goods sold pursuant to these Regulations
comprise items selected from those available on our Website
c. Price The price of goods purchased via the website shall be the price
advertised on our price list at the time of purchase together with the Value
Added Tax and any other relevant tax thereon at prevailing rates from time to time
d. Delivery Costs Goods are delivered directly to your home address at
an additional cost (please see our deliveries chart)
e. Payment Payment for any goods purchased pursuant to these terms must
be paid by debit or credit card at the time of placing the order and prior
to delivery
f. Cancellation In accordance with the Regulations and in certain circumstances
you have the right of cancellation within seven days, see legal notices 2

We want you to be totally satisfied with any purchase you make from Amazing
Emporium. It is our aim to offer you the highest quality at the most
competitive prices. If you are not completely happy with your purchase please
contact us as soon as possible.
Under the United Kingdom's Distance Selling Regulations you have the right to
return any items you buy on this website within seven days of you receiving
the goods.
This does not apply to:
- items made to your specification
- for hygiene reasons, mattresses, bed linen and divan bases
You will be responsible for any costs incurred, such as return and disassembly.
To cancel, you can fax or write (signature required) to us within seven working
days of the delivery. You must take reasonable care of the goods and not use
them. Items can be returned or we can arrange collection at the customer’s
expense.
This return policy does not affect your statutory rights.
